Terms of Service

These terms are the legal agreement between you and Kaliu for messaging, tribe communities, discovery, and related services. By registering or using any feature, you agree to these terms.

1. Acceptance and Scope

1.1 Agreement

These Terms of Service ("Terms") are a legal agreement between you and the operator of Kaliu ("we") regarding your use of the Kaliu mobile application, official website, and related services.

These Terms, together with the Privacy Policy, in-app rules, tribe guidelines, event rules, and notices we publish from time to time, form the complete agreement. By using any part of the service, you confirm that you have read and agree to all of the above.

1.2 Eligibility

The App is intended for natural persons with full civil capacity. If you are under 18, you should read these Terms and use the service under guardian guidance. If you are under 14, you may not register or use the App.

1.3 Changes

We may revise these Terms as required by law or business needs. Material changes will be notified via in-app dialog, in-app notice, or website announcement. Continued use means acceptance; if you disagree, stop using the service and cancel your account.


2. Account Registration and Security

2.1 Registration

You must register with a real, lawful, and valid mobile number or other method we support, and ensure information is accurate and complete.

2.2 Account Use

Your account is for your personal use only. You may not rent, lend, transfer, sell, or otherwise allow others to use it. You are responsible for safeguarding your account, password, and verification codes.

2.3 Security Incidents

If you believe your account has been compromised, contact us immediately through in-app channels or support. We will assist within reasonable limits but are not liable for losses caused by your negligence or force majeure.

2.4 Cancellation

You may cancel your account as described in the Privacy Policy and in-app guidance. After cancellation, you cannot continue using the service; data will be handled as required by law and the Privacy Policy.


3. Services

Kaliu provides the following (as actually available in the App):

3.1 Instant Messaging (IM)

  • One-to-one and group chat with text, images, voice, video, files, and other message types;
  • Notifications, read status, and conversation management;
  • Settings for who may message you and session privacy modes (as available in the App).

3.2 Tribe Communities

  • Create, join, and manage tribes;
  • Post, comment, like, and share;
  • Organize or join tribe events;
  • Tribe admins may manage members and content per in-app permissions and rules.

3.3 Discovery and Social Graph

  • Discovery and recommendations based on interests, location (with your permission), etc.;
  • Follow, friends, friend requests, and verification mechanisms;
  • Albums, events, encounter records, and related features.

3.4 Bluetooth and Hardware Devices

  • Bluetooth scanning, device pairing, encounter records (with your permission);
  • Data use is governed by the Privacy Policy.

3.5 KaliuAI and Smart Services

  • Smart recommendations, Q&A assistants, etc.;
  • AI output is for reference only and is not professional advice; you are responsible for decisions you make based on AI content.

3.6 Other Services

We may launch new features or adjust existing ones and will notify you in a reasonable manner.

3.7 Changes and Interruption

Service may be interrupted, delayed, or adjusted due to maintenance, upgrades, failures, force majeure, or third parties. We will try to restore service but are not liable for indirect losses except where law requires otherwise.


4. User Conduct

You must comply with applicable laws, public order, and these Terms. You must not:

4.1 Illegal and Harmful Content

  • Post or spread content that endangers national security, disrupts public order, promotes violence or terrorism, is obscene, involves gambling or fraud, or otherwise violates law;
  • Infringe intellectual property, reputation, privacy, portrait rights, or other lawful rights;
  • Spread false or misleading information, or impersonate others or organizations.

4.2 Harassment and Abuse

  • Abuse, threaten, harass, doxx, spam private or group messages;
  • Send spam ads, pyramid schemes, phishing links, or malicious referrals;
  • Use technical means to interfere with or damage the service (e.g., crawlers, attacks, cheats).

4.3 IM and Community-Specific Prohibitions

  • Send bulk or commercial messages without consent;
  • Post off-topic ads or traffic diversion in tribes or groups;
  • Distribute malware or malicious programs;
  • Use anonymity or groups to evade moderation or commit illegal acts.

We may warn, restrict features, remove content, suspend, or permanently ban accounts depending on severity, and report to authorities as required by law.


5. User-Generated Content (UGC)

5.1 Ownership

You retain copyright in text, images, audio, video, comments, posts, and other content you publish, subject to third-party rights.

5.2 License to Us

To operate the App (display, store, transmit, recommend, moderate, backup, and enforce rights), you grant us a worldwide, royalty-free, non-exclusive, sublicensable license limited to operating the App. This license ends within a reasonable technical period after you delete content or cancel your account, except where law requires retention.

5.3 Your Representations

You represent that you have the rights or authorization for content you post and that it does not infringe others. You bear disputes and losses caused by your content; we may seek recovery if you cause us loss.

5.4 Moderation

We may (but are not obligated to) review UGC and may remove, block, or restrict content suspected of violation without prior notice.


6. Tribes, Groups, and Events

6.1 Tribe Administration

Creators and admins must comply with law and platform rules and must not abuse admin powers for illegal activity.

6.2 Group Order

Members must respect others and must not post illegal or harassing content. Group owners/admins may remove violators (per in-app features).

6.3 Offline Events

For offline events organized through the App, safety is primarily the responsibility of organizers and participants; we provide information and connection tools only and are not liable for personal or property harm at offline events except where caused by our intent or gross negligence.


7. Privacy

We value your privacy. Collection, use, storage, and protection of personal information are described in the Privacy Policy. Using the App means you also agree to the Privacy Policy.


8. Intellectual Property

8.1 Platform Rights

Software, UI, trademarks, logos, documentation, and other content in the App belong to us or licensors. You may not copy, modify, distribute, or use them commercially without written permission.

8.2 Infringement Complaints

If you believe content in the App infringes your IP rights, contact legal@kaliu.app with proof of rights and infringement details. We will handle complaints in accordance with law.


9. Paid Services (If Any)

If we offer membership, virtual goods, or other paid services:

  • Price, benefits, and validity are as shown in the App;
  • Except where law requires refunds, virtual goods are generally non-refundable once purchased;
  • Pay only through official channels and beware of fraud.

10. Disclaimer and Limitation of Liability

10.1 "As Is" Service

To the extent permitted by law, we provide the service on an "as is" and "as available" basis without warranties of uninterrupted service, error-free operation, or fitness for a particular purpose.

10.2 User Content and Third Parties

  • Disputes between you and other users are primarily between you; we may assist within reason but are not jointly liable;
  • Third-party links, services, or SDKs are the responsibility of those third parties.

10.3 Cap on Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, or punitive damages arising from use or inability to use the service. Our total liability is limited to fees you paid us in the past 12 months (or CNY 100 if none), except where law mandates otherwise.


11. Termination

11.1 By You

You may stop using the service and cancel your account at any time.

11.2 By Us

If you violate these Terms, law, or harm the platform or other users, we may suspend or terminate service and reserve the right to pursue legal remedies.

11.3 Effect

After termination, provisions that by nature should survive (e.g., IP, disclaimer, dispute resolution) remain in effect.


12. Governing Law and Disputes

12.1 Governing Law

These Terms are governed by the laws of the People's Republic of China (mainland), excluding conflict-of-law rules.

12.2 Dispute Resolution

Disputes shall first be resolved through good-faith negotiation. If negotiation fails, either party may bring suit in a court with jurisdiction at our place of domicile.


13. Miscellaneous

13.1 Severability

If any provision is held invalid, the remainder remains in effect.

13.2 Headings

Section headings are for convenience only and do not affect interpretation.
